Investor anger is mounting over the initial public offering of Facebook stock last week, which was fumbled by the banks that managed the deal and complicated by technical problems at the Nasdaq stock exchange.

Shareholders filed at least two lawsuits against Facebook and Morgan Stanley, the bank that shepherded the IPO, over reports that it withheld negative analyst reports about Facebook from some clients before the company went public.

It was the second stumble this month by a major Wall Street firm. JPMorgan Chase, usually revered for taming risk, has yet to contain a growing $2 billion loss in one of its trading units.

The missteps are further eroding the confidence of small-scale investors, or what was left of it after the financial meltdown of 2008.

Judson Gee, a financial adviser in Charlotte, N.C., placed a call Wednesday morning to a client who had plowed $50,000 into Facebook stock on Friday, the day of the IPO.

Gee said he called to tell the client, a restaurateur, about reports that Morgan Stanley had told only select customers about an analyst's reduction of revenue estimates for Facebook just before the IPO.

"I could see his jaw dropping on the other side," Gee said. "A lot of expletives came out." He said his client had asked: "How can they give that information to the big boys and not give it to the public?"

In the final planning of the IPO, Facebook, working with Morgan Stanley, raised the total number of shares being offered for sale by 25 percent, to 421 million. They expected extraordinary demand for the stock by investors.

That appears to have been a miscalculation. Facebook stock jumped from $38 to as high as $45 in the opening minutes, but quickly sank toward $38 again. It dropped to about $34 on Monday and $31 on Tuesday. The stock recovered somewhat on Wednesday and climbed $1.

Dayna Steele, a motivational speaker in Houston, said she plans to wait and buy the stock "when everybody finishes suing each other."

The shareholder lawsuit, filed in federal court in Manhattan, accuses Morgan Stanley of withholding the negative analyst report from some clients while it prepared to take the stock public.

One of the investors suing, Dennis Palkon, a professor at Florida Atlantic University, said that IPOs are tricky, but "this one had a lot of glamour, had a lot of interest. (Facebook) has a lot of users. I thought it'd be a pretty good investment."

He bought 1,800 shares of Facebook at $38 through his ETrade account, meaning that after Tuesday, he was down more than $12,000 on paper.

"I think there were problems all over the place," he said. "It was totally poor planning to raise the price as high as they did and then to add all those extra shares."

Morgan Stanley declined comment on the lawsuit, but it said on Tuesday that it had complied with regulations in how it handled analyst reports before the IPO. Facebook called the lawsuit "without merit."

The Senate Banking Committee, the Securities and Exchange Commission and other regulators also plan to look into the IPO.

Regulators will probably want to comb over Facebook's prospectus, the information it provided to potential investors, to make sure the company's disclosures were accurate and complete.

State securities laws and industry rules, mostly broader in scope than SEC rules, give state and industry regulators a wider berth to sanction investment firms that they accuse of failing to act in investors' best interest.

The first trading in Facebook stock, originally set for 11 a.m. Friday, was delayed half an hour by technical glitches at the Nasdaq Stock Market, and brokerages are still sorting through problems with orders.

A person familiar with the matter, speaking on condition of anonymity because the person was not authorized to speak publicly, told The Associated Press that Facebook was in talks with the New York Stock Exchange to move its stock listing there from Nasdaq.

The bungled IPO came little more than a week after JPMorgan CEO Jamie Dimon disclosed the $2 billion loss.

He has said the bank was hedging against financial risk, but regulators have questioned whether it was a gamble for profit instead, and have seized on the loss to make the case that Wall Street has not cleaned up its act.

Lisa Lindsley, director of capital strategies for the American Federation of State, County and Municipal Employees, which has 1.6 million members and handles pension assets of $850 million, said the union was "very concerned about the lack of internal controls at all three firms," referring to Facebook, JPMorgan and Morgan Stanley.

Elizabeth Warren, architect of the Consumer Financial Protection Bureau and a Democratic candidate for Senate from Massachusetts, said Wall Street has lost an image that once said, "We are solid and we will be here forever."

"Banking should be boring," she said, "because boring creates confidence."

As if small investors needed a reason to feel queasier, the stock market is having its worst month of the year, mostly because of concerns about a debt crisis in Europe and whether Greece will exit the euro currency group.

The Dow Jones industrial average gained 9 percent during the first four months of the year, but that has withered to 2 percent.

The Standard & Poor's 500 index more than doubled in the three years after its financial crisis low, in March 2009, and is still up 93 percent. But small investors, mistrustful of the market, are still pulling money out of stocks.

Investors withdrew $85 billion from U.S. stock mutual funds last year and have pulled more money out than they put in for five years in a row ? significant given how many Americans automatically put money in through 401(k) accounts.

They had already withdrawn $6 billion through April this year, and the decline in May figures to make the withdrawals accelerate.

When Congress passed an overhaul of financial laws in 2010, it was designed to prevent a repeat of the 2008 crisis. The details are still being written, and the financial services industry is fighting hard against many of those changes.

Two weeks ago, Treasury Secretary Timothy Geithner said the JPMorgan loss "helps make the case" for tougher rules for banks.

William Black, a former bank regulator who now teaches law and economics at the University of Missouri at Kansas City, said he believed the banks would still be able to water down the regulatory changes, even after these embarrassments.

The banks, he said, "are bringing a gun to a knife fight."

But the issues are not clear-cut. Michael Barr, a law professor at the University of Michigan who was an architect of the overhaul, said he is concerned that the Facebook episode might make it harder for other companies to raise money by taking themselves public.

"The more the system feels like it's rigged, the harder it is going to be for companies to raise money and for investors to freely participate," he said.

Ernie Patrikis, a former top official at the Federal Reserve's New York branch who is now partner in the banking regulatory practice at the law firm White & Case, said banks deserve part of the blame for spooking investors in 2008.

But he said regulators have been more rigorous since, some financial institutions have closed, and "a lot of CEOs went missing."

"I don't want to see a day of reckoning" for the banks, he said. "The banks are our lifeline."

In the gritty crime drama, he portrays a hitman who is hired by a crime boss (Ray Liotta) to find and kill a pair of overzealous upstarts who attempt to stake their claim by robbing a high-profile card game staged by Liotta's character. But according to Pitt, the role didn't disturb him at all.

"Not in any way, because murder is an accepted possibility when you're dealing in crime," he told reporters. "I would have a much harder time playing a racist or something along those lines. That would be much more unsettling for me than a guy who shoots another guy in the face." Pitt went on to say that the violence in the film is realistic in that it's not glorified for the sake of entertainment.

"We live in such a violent world. I certainly grew up hunting, which is a very violent act," he said when asked if the film was in any way influenced by the popularity of graphic video games that involve gangsters and hired killers. "Have you ever had a hamburger? Have you seen how they butcher cows? It's barbaric, it's horrendous, it's very violent. This is the world we live in, so I see it as absolutely important to film."

The Oscar-nominated actor even happily answered a quandary about whether or not his upcoming marriage to longtime love Angelina Jolie would affect his work schedule.

"We have no date. We actually really, truly have no date," he said. "It's something that makes sense to us ... and we're still hoping we figure out marriage equality in the States before then, before that date."

4G LTE,?Data Plans, and?Design?

In last year's?Fastest Mobile Networks?tests we found Sprint's 3G network to be the slowest of the nationwide networks, with average download speeds around 500Kbps. But if you're covered by WiMAX, you'll be looking at considerably faster speeds?more like 3Mbps.

Chances are, you aren't in the coverage area for Sprint's initial 4G LTE rollout, which promises significantly higher speeds than WiMAX. Sprint has said that it'll turn on LTE in Atlanta, Baltimore, Dallas, Houston, Kansas City, and San Antonio by the middle of 2012. The carrier also promises to cover 120 million Americans with LTE by the end of the year, but has yet to reveal just where that coverage will fall. That's a bummer, since it's pretty much impossible to tell if you'll be getting LTE from Sprint anytime soon. But the beauty of the Tri-Fi is that you don't have to worry about buying a device for the right network, since it supports all of them.

Sprint offers data plans for the Tri-Fi that start at $34.99 for 3GB of combined 3G and 4G data. $49.99 gets you 6GB of 3G/4G data, and $79.99 is good for 12GB. On Sprint, you get about 20 percent more data for the price than you get on similar plans from AT&T or Verizon.

You may not fall in love with the Tri-Fi at first sight. Simply put, this hotspot is huge. At 2.25 by 3.84 by .95 inches (HWD) and 4.9 ounces, it probably won't fit into your pocket of your pants the way many other hotspots can. But it's still small enough to fit into your bag or the pocket of a jacket. The front panel has a Power button and a Menu button, and there's a WPS (Wi-Fi Protected Setup) button and a Mute switch on top of the device, along with two external antenna ports and a microUSB port for charging on the bottom.

When you slide off the Tri-Fi's back cover, you get access to the microSD card slot. Stick a card in, and it becomes a shared drive for connected PCs and Macs. That back cover also hides the Tri-Fi's massive 3600 mAh battery, which is where the bulk of its size and weight come from. It's put to good use, though. We got 8 hours and 55 minutes of WiMAX streaming on one charge, which is the longest battery result we've ever seen on a hotspot; you'll likely see good results over LTE as well.

The Tri-Fi also has an informative 1.7-inch LCD on the front of the router. It gives you connection information, alerts, and billing info (including the amount of data you've used, itemized by network), among other useful options.

Setup and Administration
Using the Tri-Fi is easy. Just turn it on, and use your device's wireless connection manager to connect to it using the SSID displayed on the modem's screen. You can connect as many as eight devices this way. If you want to connect the Tri-Fi to a Windows PC as a USB modem, you can do that too. When I connected the Tri-Fi to a Windows 7 laptop with a micro-USB cable, it automatically installed its own drivers and connected as an NDIS link using Windows' built-in software.

The Tri-Fi has an excellent management console. It allows you to monitor battery life and signal strength, see what devices are connected, and control a plethora of advanced router settings. There's a comprehensive list, allowing you to change the screen backlight, set your 3G, 4G, and Wi-Fi options, and enable port forwarding, port triggering, UPnP, a DMZ, and static IP addresses.

Performance and Conclusions
After booting in about a minute, the Tri-Fi automatically connects to the fastest network available, which, in New York City where we tested, is WiMAX. You can also set the modem to connect to the network of your choice (if it's available, that is).

WiMAX speeds were solid, and on par with other devices we've seen from Sprint recently. The Tri-Fi pulled in average download speeds of 3Mbps and upload speeds around 0.8Mbps. That's no match for LTE, but it should be enough to keep you satisfied until it rolls into your town.

The Tri-Fi offers up to 115 feet of range indoors. As with most other hotspots, speeds remain consistent within about 50 feet or so of the device. Move further away than that and speeds start to decline. At 100 feet you can still get a connection, but just barely.

The Sierra Wireless 4G LTE Tri-Fi Hotspot is the best hotspot you can buy on Sprint right now. And if you want LTE when it becomes available, it's the only hotspot you can buy, period. The Overdrive Pro 3G/4G Mobile Hotspot?($49.99, 4 stars) costs $50 less up front, and is a little less bulky, but you're limited to 3G and WiMAX, and less than half the battery life of the Tri-Fi. The same is true for the Novatel Wireless 4082 MiFi?($49.99, 4 stars). So if you want to get online with LTE from Sprint, or if you need a hotspot that can last longer than any other, the Sierra Wireless 4G LTE Tri-Fi is your best bet, and thus our Editors' Choice.

Three climbers die on Mount Everest

Three climbers died while descending from the summit of Mount Everest, Nepalese officials said on Monday.

Eberhard Schaaf, 61, from Aachen, Germany, who was climbing with the Eco Everest Expedition to remove decades-old garbage from the mountain, died on Saturday along the normal Southeast Ridge Route on the 29,035-foot peak.

Shriya Shah, a 32-year-old Nepal-born woman living in Canada, and a Korean, Song Won-Bin, also died while climbing down from the summit at the weekend, Tourism Ministry official Gyanendra Shrestha said.

"Schaaf died at the South Summit of Sagarmatha due to altitude sickness," said Ang Tshering Sherpa, chief of the Asian Trekking company that organized the expedition, referring to the Nepali name of the mountain. South Summit is about 28,697 feet high.


He said the body was lying on the mountain and that Schaaf's?family as well as the German Embassy in Nepal had been informed.

"If the family wants the body to be brought down we will try, but it is very difficult to do so from that altitude," Sherpa said.

Over the weekend, a 73-year-old Japanese woman improved her own record and climbed the peak for a second time at the weekend becoming the world's oldest woman to scale the giant peak.

Two Sherpas have died so far this season -- one after falling into a crevasse and the other reportedly from altitude sickness, according to National Geographic magazine.? At least 236 people have died climbing Everest since 1950.

The deaths mark an already controversial season on Everest. On May 5, Himalayan Experience announced that it was canceling its expedition because of safety concerns. Minimal snowpack and warm temperatures, among other factors, had led to dangerous conditions, including rock fall and avalanches, the company said.

Michael Fagin, who provides forecasting services for Everest teams and runs everestweather.com from Redmond, Wash., said the spring had been very dry and windy. In the past week, winds had reached up to 80 mph; climbers on Everest prefer them under 30 mph.

Eric Simonson, Himalayan program director of International Mountain Guides, told msnbc.com last week that to cancel an Everest expedition so early was "quite unprecedented," but added it is unreasonable to expect every team to agree on how to handle difficult conditions.

"They?re betting on there being a problem and all the other expeditions that have stayed are betting on our ability to mitigate that problem. I don?t think it has to reflect poorly on anyone."

Last week, the National Geographic-North Face expedition, led by accomplished mountaineer Conrad Anker, canceled its plans to summit via the West Ridge due to icy conditions, but will still attempt to reach the peak via a different route.

About 300 climbers remain on the mountain?at different camps waiting for a window of good weather to try to climb the peak before the onset of annual monsoon rains next month,?which effectively ends the?climbing?season in the Himalayas.

CDC: Half of overweight teens have heart risk

ATLANTA (AP) ? Half the nation's overweight teens have unhealthy blood pressure, cholesterol or blood sugar levels that put them at risk for future heart attacks and other cardiac problems, new federal research says.

And an even larger proportion of obese adolescents have such a risk, according to the alarming new numbers.

"What this is saying, unfortunately, is that we're losing the battle early with many kids," said Dr. Stephen Daniels, a University of Colorado School of Medicine expert who was not involved in the study.

People can keep their risk of heart disease very low if they reach age 45 or 50 at normal weight and with normal blood pressure, normal cholesterol and no diabetes. So these results are not good, he said.

The study was released Monday in the journal Pediatrics.

The Centers for Disease Control and Prevention research focused on 3,383 adolescents ages 12 through 19. The youths were part of an intensive national study that involves interviewing, weighing, measuring and performing medical tests on people across the country.

The ongoing CDC study is considered a gold standard for looking at national health trends, said Dr. William Mahle, an Emory University pediatric cardiologist.

So there was some good news, Mahle said, that the study found no increase in levels of obesity, high blood pressure or bad cholesterol during the years it covered ? 1999 through 2008.

"All of us are looking for some sign or signal that we're making headway," said Mahle, who was not involved with the study. "So that was reassuring."

But one measure did get worse: The percentage of adolescents who were diagnosed with diabetes or pre-diabetes rose dramatically, from 9 percent to 21 percent. Pre-diabetics have higher than normal blood sugar levels, but not high enough to count as diabetes.

It's not clear why the proportion of kids with high blood sugar would increase while the measures for the other heart disease risk factors held steady. It may have something to do with the kind of test used to measure blood sugar, Daniels said.

Adolescents in the study were given a blood test that can give varying results depending on the day or time of day the test is given. Other tests, though more involved and more expensive, are considered more precise.

Daniels said it's possible another testing method might not have produced a swing so large.

That is possible, said Ashleigh May, the CDC epidemiologist who was the study's lead author.

"This study is just a first step to identify problems in youth. More work needs to be done to identify why this is happening and the advantages of using various test methods in this population," she said.

Overall the study found that 50 percent of overweight youths and 60 percent of obese youths had at least one risk factor for future heart disease.

But normal-weight kids aren't off the hook ? 37 percent had at least one risk factor and could face increased chances for heart trouble as adults, the study suggests.

APNewsBreak: 22 states join campaign finance fight

HELENA, Mont. (AP) ? Twenty-two states and the District of Columbia are backing Montana in its fight to prevent the U.S. Supreme Court's 2010 Citizens United decision from being used to strike down state laws restricting corporate campaign spending.

The states led by New York are asking the high court to preserve Montana's state-level regulations on corporate political expenditures, according to a copy of a brief written by New York's attorney general's office and obtained by The Associated Press. The brief will be publicly released Monday.

The Supreme Court is being asked to reverse a state court's decision to uphold the Montana law. Virginia-based American Tradition Partnership is asking the nation's high court to rule without a hearing because the group says the state law conflicts directly with the Citizens United decision that removed the federal ban on corporate campaign spending.

The Supreme Court has blocked the Montana law until it can look at the case.

The Montana case has prompted critics to hope the court will reverse itself on the controversial Citizens United ruling. The 22 states and D.C. say the Montana law is sharply different from the federal issues in the Citizens United case, so the ruling shouldn't apply to Montana's or other state laws regulating corporate campaign spending.

But the states also said they would support a Supreme Court decision to reconsider portions of the Citizens United ruling either in a future case or in the Montana case, if the justices decide to take it on.

Legal observers say don't count on the Supreme Court reconsidering its decision.

"It is highly unlikely that the Court would reverse its decision in Citizens United," said law professor Richard L. Hasen of the University of California-Irvine.

At best, the court would listen to arguments and might agree a clarification is needed to allow the Montana law to stand. But even that is a long shot, Hasen said.

Montana Attorney General Steve Bullock argues that political corruption in the Copper King era led to the state ban on corporate campaign spending. A clarification of Citizens United is needed to make clear that states can block certain political spending in the interest of limiting corruption, he said.

American Tradition Partnership argues that the state bans unfairly restrict the ability of corporations to engage in the political process that also affects them.

Bullock wrote in a brief to be released Monday that the state does not "ban" corporate political speech, rather, it regulates that speech by requiring the formation of political action committees.

The Democrat, who is running for governor, said the upstart political corporations hoping to take advantage of unfettered spending are merely "an anonymous conduit of unaccountable campaign spending."

Montana and the other states are asking the court to either let the Montana Supreme Court decision stand or to hold a full hearing. They argue laws like the one in Montana that bans political spending straight from corporate treasuries are needed to prevent corruption.

The other states, many with their own type of restrictions hanging in the balance, argue local restrictions are far different than the federal ban the court decided unconstitutionally restricted free speech. Further, state elections are at much greater risk than federal elections of being dominated by corporate money, requiring tailored regulation, the states' court filing says.

"The federal law struck down in Citizens United applied only to elections for President and U.S. Congress," New York Attorney General Eric Schneiderman wrote on behalf of the states. "By contrast, Montana's law applies to a wide range of state and local offices, including judgeships and law enforcement positions such as sheriff and county prosecutor."

The joining states, unlike Montana, ask the court to go further and reconsider core findings in Citizens United. They argue, for instance, it was wrong for the court to say unlimited independent expenditures rarely cause corruption or the appearance of corruption.

And other critics of the Citizens United decision who believe the court was wrong to grant corporations constitutional rights, have intervened and asked the court to reverse itself.

"There is a growing bipartisan consensus that Citizens United needs to be overturned, and Montana is leading the way," said Peter Schurman, spokesman for a group called Free Speech For People. "The Supreme Court has an opportunity to revisit Citizens United here. That is important because there is evidence everywhere that unlimited spending in our elections creates both corruption and the appearance for corruption."

On Friday, Montana's case was given a boost when U.S. Sens. John McCain, R-Ariz., and Sheldon Whitehouse, D-D-R.I., signed on in support. The senators argue evidence following the Citizens United decision, where millions in unregulated money has poured into presidential elections, shows that large independent expenditures can lead to corruption.

The states who filed the brief in support of Montana are New York, Arkansas, California, Connecticut, Delaware, Hawaii, Idaho, Illinois, Iowa, Kentucky, Maryland, Massachusetts, Minnesota, Mississippi, Nevada, New Mexico, North Carolina, Rhode Island, Utah, Vermont, Washington, West Virginia and the District of Columbia.

Statins prevent cancer and reduce death from all causes in heart transplant recipients. The findings were independent of cholesterol levels.

The research was presented at the Heart Failure Congress 2012, 19-22 May, in Belgrade, Serbia. The Congress is the main annual meeting of the Heart Failure Association of the European Society of Cardiology.

Cancer is the leading cause of death late after heart transplantation. Skin cancer is particularly common, but solid organ cancers including colorectal cancer, prostate cancer and lymphoma also occur. The increased rate of cancer in heart transplant recipients may be related to the immune suppression of the patient.

Statins are immunomodulatory drugs and may benefit patients beyond their lipid lowering effects. The current study (abstract P306) investigated the impact of statin therapy on the occurrence of cancer and death from all causes in heart transplantation recipients.

The study included all 255 patients who underwent heart transplantation at the University Hospital Zurich in Switzerland between 1985 and 2007 and were alive after the first year. The primary endpoint was the occurrence of any cancer and the secondary endpoint was overall survival.

During follow up, cancer was diagnosed in 108 patients (42%). Statins reduced the risk of any cancer by 65% (p=0.0001). Eight years after transplantation the cumulative incidence of tumours was 34% in patients not receiving a statin compared to 13% in patients receiving a statin (p=0.003). The benefit persisted at the 10 year (39% vs. 18%) and 12 year follow-up (42% vs. 22%).

Statin use was associated with improved cancer free and overall survival (both p=0.0001). The beneficial effect of statins on preventing cancer and reducing death from all causes was independent of patients' cholesterol levels. This suggests that the benefit of statins was due to their immunomodulatory effects.

Lead author Dr Frank Enseleit, deputy director of heart failure and transplantation at University Hospital Zurich, says patients can safely begin statin therapy six months after transplantation and they should take the drug for the rest of their lives.

"We have shown that statin therapy prevents cancer in heart transplant recipients and it is known that statins also prevent graft atherosclerosis," he says. "We have to conclude that it should be a lifelong therapy in heart transplant recipients."

Statins prevent cancer and reduce death from all causes in heart transplant recipients. The findings were independent of cholesterol levels.

The research was presented at the Heart Failure Congress 2012, 19-22 May, in Belgrade, Serbia. The Congress is the main annual meeting of the Heart Failure Association of the European Society of Cardiology.

Cancer is the leading cause of death late after heart transplantation. Skin cancer is particularly common, but solid organ cancers including colorectal cancer, prostate cancer and lymphoma also occur. The increased rate of cancer in heart transplant recipients may be related to the immune suppression of the patient.

Statins are immunomodulatory drugs and may benefit patients beyond their lipid lowering effects. The current study (abstract P306) investigated the impact of statin therapy on the occurrence of cancer and death from all causes in heart transplantation recipients.

The study included all 255 patients who underwent heart transplantation at the University Hospital Zurich in Switzerland between 1985 and 2007 and were alive after the first year. The primary endpoint was the occurrence of any cancer and the secondary endpoint was overall survival.

During follow up, cancer was diagnosed in 108 patients (42%). Statins reduced the risk of any cancer by 65% (p=0.0001). Eight years after transplantation the cumulative incidence of tumours was 34% in patients not receiving a statin compared to 13% in patients receiving a statin (p=0.003). The benefit persisted at the 10 year (39% vs. 18%) and 12 year follow-up (42% vs. 22%).

Statin use was associated with improved cancer free and overall survival (both p=0.0001). The beneficial effect of statins on preventing cancer and reducing death from all causes was independent of patients' cholesterol levels. This suggests that the benefit of statins was due to their immunomodulatory effects.
